Washington State Faces Ballot Measures Targeting Transgender Rights

A campaign has been launched to oppose two conservative-backed ballot initiatives in Washington state that critics argue will harm the rights of transgender individuals and young people.

A new campaign, “No Hate in WA State,” has been launched by Democratic leaders and advocacy groups to oppose two ballot initiatives that opponents claim will undermine the rights of transgender individuals, particularly youth. The initiatives, backed by conservative multimillionaire Brian Heywood through his political action committee (PAC) Let’s Go Washington, are set to appear on the state ballot in November.

U.S. Representative Pramila Jayapal, speaking at the campaign’s kick-off event in Seattle, strongly criticised the initiatives, labelling them as “lies that are bankrolled by MAGA Trump donors.” She detailed the potential impact of the measures, stating that one initiative could force schools to disclose LGBTQIA+ identifications of students to their families, potentially leading to negative consequences for those students. The other initiative, she explained, would mandate invasive examinations for girls participating in sports, with the stated aim of targeting transgender athletes.

Brian Heywood has personally contributed a significant sum of $1,975,000 to support the passage of these initiatives. Let’s Go Washington has collectively raised nearly $5.5 million. In contrast, the opposition, represented by No Hate in WA State and another PAC, Defend Washington, has raised $1.1 million as of June 11, indicating a substantial fundraising advantage for the proponents.

Beyond the measures directly impacting transgender rights, Let’s Go Washington is also advocating for the repeal of the state’s “millionaires’ tax,” a 9.9% tax on income exceeding $1 million, which is scheduled to take effect in 2029.

Jaelynn Scott, Executive Director of the Lavender Rights Project and a candidate for the state legislature, addressed the rally, linking the anti-trans initiatives to broader issues of money and politics. Scott argued that the initiatives are not solely driven by transphobia but also by the influence of wealthy individuals seeking to manipulate democracy.

The political landscape in Washington is further complicated by Let’s Go Washington’s involvement with Full Court Press, a “dark money” group active in campaigns for the state Supreme Court justices. With five justices up for election, there is a possibility of a shift towards a more conservative court, which could influence the legal challenges these initiatives might face if passed.

Parental Rights and Education Policy

The current initiatives build upon previous legislative efforts concerning parental rights in education. In 2024, Let’s Go Washington supported an initiative that sought to establish a “parental bill of rights,” requiring schools to inform parents about their children’s educational and medical information. This initiative was passed into law by the state legislature rather than being put to a public vote.

However, the following year, a “clean-up” bill, House Bill 1296, sponsored by Representative Monica Stonier, introduced significant amendments. This bill removed parental access to medical records to align with existing state law and introduced new anti-discrimination protections for students, including those based on gender identity and neurodivergence. Stonier explained her intent was to create a more inclusive list of parental rights and to reclaim student and educator rights, ensuring safe school environments.

The current initiative, IL26-001, seeks to reverse some of these changes, notably aiming to restore parental access to medical and mental health records. It also proposes removing language that prohibits discrimination in public education based on various factors, including sexual orientation and gender identity. The initiative includes a provision preventing the legislature from altering it for two years post-passage.

Advocates argue that unrestricted parental access to medical records could lead to the forced “outing” of LGBTQ+ youth who are seeking support from school personnel. Citing a 2011-2012 survey, they highlight that a significant percentage of homeless youth were forced from their homes due to their sexual orientation or gender identity, underscoring the potential harm of such disclosures.

Linden Jordan of PFLAG Washington State emphasized that the initiative is not about facilitating parental engagement but rather about safeguarding a child’s right to privacy while they explore their identity. They stressed the critical role of trusted adults in schools, such as counselors, nurses, teachers, and coaches, as potentially life-saving resources for students.
